Your privacy is important to us.

Soundable Health, Inc. (“Soundable Health”) values your support and is committed to protecting your privacy. This statement (the “Privacy Policy”) sets forth our policies and practices for handling your information on the Soundable Health website (the “Site”), the Soundable Health mobile applications (the “App”), and any other websites, applications, and online services that we operate and that link to this Privacy Policy (collectively, the "Services").

I. COLLECTION OF INFORMATION

We may collect the following kinds of information when you use the Services:
Information you provide directly to us. For certain activities, such as when you register, subscribe to our alerts, interact with the Services, or contact us directly, we may ask you to provide some or all of the following types of information:

  • Contact and registration information, such as full name, email address, mobile phone number, and address;

  • Username and password;

  • Date of Birth;

  • Sex (Male or Female);

  • Data you enter into the Services, such as logs of activities or questionnaire responses;

  • Information about your health;

  • Other information you provide directly to us, such as when you provide feedback or send correspondence to us.

We do not collect the payment information (such as credit card or debit card number) needed to complete a transaction. Apple Pay (the Payment Processor) collects the payment information with respect to purchases made through the Services, and the payment processor collects the payment information. The Payment Processor provides us with limited data related to you, a unique token that informs the transaction that does not include credit card or debit card numbers. Your payment data is stored with the Payment Processor, it’s never stored on the Company’s server.

Information we collect automatically. We may collect certain information automatically when you use our Services, such as audio data necessary to provide the Services, your Internet protocol (IP) address, device identifiers, browser type, operating system, apps installed on your device, Internet service provider, pages that you visit before and after using the Services, the date and time of your visit, information about the links you click and pages you view within the Services, and other standard server log information.

We may use cookies, pixel tags, Local Storage Objects, and similar technologies to automatically collect this information. Cookies are small bits of information that are stored by your computer’s web browser. Pixel tags are very small images or small pieces of data embedded in images, also known as “web beacons” or “clear GIFs,” that can recognize cookies, the time and date a page is viewed, a description of the page where the pixel tag is placed, and similar information from your computer or device. By using the Services, you consent to our use of cookies and similar technologies.

Information we obtain from other sources. We may receive information about you from other sources, including through third-party services and organizations such as a third-party validation service or other publicly or commercially available sources. Information that is collected when you use the Services may be combined with other information collected from you or from third parties. For example, if you access third-party services, such as Facebook, Google, or Apple, through the Services in order to login to the Services or to share information about your experience on the Services with others, we may collect information from these third-party services.

II. USE OF INFORMATION

We only use payment information, such as credit card numbers, expiration date, and security codes, as necessary to complete a particular transaction or as otherwise required by law.

We generally use the information we collect to

  • Administer the Services and provide you with the Services and information that you request;

  • Manage accounts and to manage our relationship with you, including to authenticate your account and notify you about changes to the Soundable Health Terms of Use and this Privacy Policy;

  • Communicate with you, including to send you promotional materials from us or on behalf of our affiliates and trusted third-party partners;

  • Analyze the use of the Services and user data to understand and improve the Services;

  • Customize the content you see when you use the Services;

  • Comply with applicable laws and regulations, protect or exercise our legal rights or defend against legal claims, and keep the Services, our business and our users safe and secure;

  • Prevent potentially prohibited or illegal activities and otherwise in accordance with the Soundable Health Terms of Use; and

  • For any other purposes disclosed to you at the time we collect your information or pursuant to your consent.

III. DISCLOSURE OF INFORMATION

We are committed to maintaining your trust, and we want you to understand when and with whom we may share the information we collect.

  • Authorized third-party vendors and service providers. We share your information with third-party vendors and service-providers that help us with specialized services, including email deployment, business analytics, marketing, and data processing.

  • Corporate affiliates. We may share your information with our corporate affiliates.

  • Business transfers. We may share your information in connection with a substantial corporate transaction, such as the sale of a website, a merger, consolidation, asset sale, or in the unlikely event of bankruptcy.

  • Legal purposes. We may disclose information to respond to subpoenas, court orders, legal process, law enforcement requests, legal claims or government inquiries, and to protect and defend the rights, interests, safety, and security of Soundable Health, our affiliates, users, or the public.

  • With your medical provider. If you access the Services using a code provided by a medical provider, we may share information with the medical provider.

  • With your consent. We may share information for any other purposes disclosed to you at the time we collect the information or pursuant to your consent.

If you access third-party services--such as social media services or third-party single sign-on tools--through the Services, these third-party services may be able to collect information about you, including information about your activity on the Services, in accordance with their own privacy policies.

If you choose to engage in public activities on the Services, you should be aware that any information you share there can be read, collected, or used by other users of these areas. You should use caution in disclosing personal information while participating in these areas. We are not responsible for the information you choose to submit in these public areas.

Aggregated or de-identified data is not subject to this Privacy Policy and may be shared with additional third parties for research and other purposes.

IV. SECURITY

We use reasonable measures to help protect information from loss, theft, misuse and unauthorized access, disclosure, alteration and destruction. You should understand that no data storage system or transmission of data over the Internet or any other public network can be guaranteed to be 100 percent secure. Please note that information collected by third parties may not have the same security protections as information you submit to us, and we are not responsible for protecting the security of such information.

You are responsible for taking reasonable steps to ensure that no unauthorized person has access to your password or account login information, as applicable. It is solely your responsibility to control the use of login information and a password, to authorize, monitor, and control access to and use of your account and password, and to inform Soundable Health promptly of any need to deactivate a password. It is also your responsibility to ensure that your devices are protected with passcode controls and are kept current with software and security updates, and have a passcode enabled, to minimize the risk of compromise by a malicious actor.

V. YOUR CHOICES

You may be able to refuse or disable cookies by adjusting your web browser settings. Because each web browser is different, please consult the instructions provided by your web browser (typically in the “help” section). You can request to delete your information by contacting privacy@soundable.health.

If you choose to refuse, disable, or delete these technologies, some of the functionality of the Services may no longer be available to you.

VI. THIRD-PARTY LINKS

This Privacy Policy applies only to the Services. The Services may contain links to content maintained by third parties that we do not control. We are not responsible for the privacy practices of these third parties, and the information practices of these third parties are not covered by this Privacy Policy. We allow third parties, including business partners, to collect information about your activities on the Services through cookies, pixels, local storage, and other technologies. Some of these third parties are members of the Network Advertising Initiative and/or the Digital Advertising Alliance, which offer a simple mechanism to opt out of ad targeting from member companies. Do-Not-Track Signals and Similar Mechanisms. Some web browsers transmit "do-not-track" signals to websites. Because of differences in how web browsers incorporate and activate this feature, it is not always clear whether users intend for these signals to be transmitted, or whether they even are aware of them. We currently do not take action in response to these signals.

VII. INTERNATIONAL USERS

The Services are designed for and targeted to U.S. audiences and are governed by and operated in accordance with the laws of the U.S. We make no representation that the Services are operated in accordance with the laws or regulations of any other nations. By using the Services and providing us with information, you understand and agree that your information may be transferred to and stored on servers located outside your resident jurisdiction and, to the extent you are a resident of a country other than the United States, that you consent to the transfer of such data to the United States for processing by us in accordance with this Privacy Policy.

VIII. CHANGES TO THE PRIVACY POLICY

We may update this Privacy Policy from time to time. When we update the Privacy Policy, we will revise the “Effective Date” date above and post the new Privacy Policy. We recommend that you review the Privacy Policy each time you visit the Services to stay informed of our privacy practices.
